TERMS AND CONDITIONS – WWW.BERYLCOOK.COM
Please take a moment to read these relatively brief terms and conditions. These may be updated at any time without notice.
Ordering and payment
All orders for goods shall be deemed to be an offer by you (the purchaser) to purchase goods and any acknowledgement of your order is merely to report that your request has been received and will be looked at. It does not denote acceptance of your order as availability of goods needs to be verified. You shall be responsible for ensuring the accuracy of the details provided when ordering. We will not be obliged to accept an order unless all details requested have been stated correctly.
Every effort is made to ensure the accuracy of the prices displayed but, in the event that there is a pricing error on the website, we will not be bound to honour any orders made at that price. Any orders received will be deemed as offers to buy and not an acceptance of any offer to sell. We will advise you on the availability of the items ordered and the cost of shipping. You may cancel your order without penalty should these costs be unacceptable.
No order submitted by you shall be deemed to be accepted by us unless and until we confirm acceptance of your order by e-mail (where applicable) or telephone.
Where a limited edition is sold out, we will try to source a copy on the secondary market. If this price differs from that shown on the website, we will advise you before accepting your order.
By placing an order you consent to payment being charged to your credit card as detailed at the time of your order. Upon payment, title to the goods will pass to you and we will send you a receipted invoice by post.
Prices are shown in £UK (Pounds Sterling) both inclusive and exclusive of VAT and may be subject to change and availability. (VAT sales tax is not charged on orders taken from and delivered outside the European Community.) Postage and packing is chargeable as an additional cost and will vary with destination and quantity shipped. All charges will be confirmed to you prior to your committing to purchase. You are responsible for payment of any local customs and import duties.
Goods will be delivered to the address provided by you, typically within 2 working days for limited and open editions. This may be longer if we need to source a print that is out of stock.
If you have not received the item(s) within the expected time please advise us so that we can attempt to trace the package. Any dates quoted for delivery are approximate only and we will not be liable for any delay. It is your responsibility to ensure that you order from us in adequate time to prevent any disappointment resulting from late or non-shipment.
Changes to the delivery address after the goods have been despatched are liable to an additional charge.
Whilst we carefully check everything we sell, sometimes items may be defective in some way and you can rest assured that we will do all we can to rectify any fault.
When you receive your goods, please check them immediately. Any damage must be notified to us within 2 days of receipt of your order. We will arrange for collection and replacement. If this is not possible, you have the option of choosing an alternative or a full refund.
Further, under the United Kingdom’s Distance Selling Regulations, you have the right to cancel the contract for the purchase of items within a period of 7 working days, beginning with the day after the day on which the item is delivered.
Should you decide that you wish to change your mind, you must notify us of your intent within 7 days of receiving your order and we will refund the cost of goods as soon as we have received them in perfect condition. The refund is for the cost of goods only and does not cover the initial costs of despatching the goods to you and you are responsible for the costs of returning the goods to us. You are also responsible for ensuring the goods are insured adequately as we will not be liable for any damage or loss to the goods whilst being returned to us. Please package the relevant item securely and send it to us so that we receive it within 7 working days of the date that you notify us of your desire to cancel. The return address is:
For your protection, we recommend that you use a insured recorded-delivery service. Please note that you will be responsible for the costs of returning the goods to us safely unless we delivered the item to you in error or the item is faulty.
The right to cancel your order during the 7-day cooling-off period will not apply for goods made to your specifications i.e. should a bespoke frame be ordered.

You warrant that all details provided by you for the purpose of purchasing the goods are correct, that the credit card you are using is your own and that there are sufficient funds and/or sufficient unused limit available to cover the cost of the goods.
